An act to add and repeal Section 33319.7 of the Education Code, relating to pupil safety.

AB 2291, as amended, Lackey. Pupil safety: harassment: AI-generated deepfakes: hotline and portal. nonconsensual intimate images: study.
Existing law establishes the State Department of Education under the administration of the Superintendent of Public Instruction and assigns to the department numerous responsibilities relating to the governance of the public elementary and secondary schools in the state.
This bill would require the department to conduct a study on nonconsensual intimate images involving pupils in kindergarten and grades 1 to 12, inclusive, and would require the study to include, among other things, a summary of the resources for schools regarding nonconsensual intimate images and the effects of nonconsensual intimate images on pupils. The bill would require the department, on or before January 1, 2028, to complete and submit the study to the appropriate fiscal and policy committees of the Legislature. The bill would repeal these provisions on January 1, 2032.

Existing law requires school districts, county offices of education, and charter schools to adopt procedures for preventing acts of bullying, including cyberbullying. Existing law requires the State Department of Education to make available to school districts on its internet website a list of resources and instructional materials on the ability to access, analyze, evaluate, and use media and encompasses the foundational skills that lead to a diverse set of skills related to current technology and social media, including the norms of appropriate, responsible, and healthy behavior.

This bill would state the intent of the Legislature to enact future legislation to establish a confidential hotline and digital reporting portal that would allow pupils in kindergarten or any of grades 1 to 12, inclusive, to report instances of harassment caused by the use of AI-generated deepfakes and receive immediate, trauma-informed guidance without fear of retaliation or punishment.

The people of the State of California do enact as follows:


SECTION 1.

 Section 33319.7 is added to the Education Code, immediately following Section 33319.6, to read:

33319.7.
 (a) The department shall conduct a study on nonconsensual intimate images involving pupils in kindergarten and grades 1 to 12, inclusive. The study shall include, but not be limited to, all of the following:
(1) A summary of the resources available for schools regarding nonconsensual intimate images.
(2) The number of incidents involving nonconsensual intimate images of pupils in kindergarten and grades 1 to 12, inclusive, reported to local educational agencies and local law enforcement agencies since January 1, 2024, the responses to those incidents, and the outcomes of those reported incidents.
(3) The effects of nonconsensual intimate images on pupils in kindergarten and grades 1 to 12, inclusive.
(4) Recommended revisions to school policies and procedures to ensure compliance with Title IX of the federal Education Amendments of 1972 (20 U.S.C. Sec. 1681 et seq.).
(5) A summary of current policies and procedures used by schools to respond to incidents involving nonconsensual intimate images.
(b) On or before January 1, 2028, the department shall complete and submit the study described in subdivision (a) to the appropriate fiscal and policy committees of the Legislature.
(c) (1) A study to be submitted pursuant to subdivision (b) shall be submitted in compliance with Section 9795 of the Government Code.
(2) Pursuant to Section 10231.5 of the Government Code, this section is repealed on January 1, 2032.

SECTION 1.

It is the intent of the Legislature to enact future legislation to establish a confidential hotline and digital reporting portal that would allow pupils in kindergarten or any of grades 1 to 12, inclusive, to report instances of harassment caused by the use of AI-generated deepfakes and receive immediate, trauma-informed guidance without fear of retaliation or punishment.
